Man gets 10 years for Elgin shooting

A northwest suburban man was sentenced to 10 years in prison for shooting another man on an Elgin porch last year.

Victor Rivera, 24, pleaded guilty to one count of aggravated battery with a firearm and one count of possession of a controlled substance, both felonies, for the May 27, 2015, shooting, according to the Kane County state’s attorney’s office.

About 4 a.m. that morning, Rivera was outside the 33-year-old victim’s home in the first block of North DuBois Avenue in Elgin when they got into an argument. The older man got up to go inside and Rivera shot him twice, prosecutors said.

The man was taken to Saint Joseph Hospital in Elgin with injuries that weren’t considered life-threatening, Elgin police said at the time.

Eleven days later, police conducting a separate drug investigation pulled Rivera over while he was driving in Elgin, and found 27.5 grams of cocaine in his car, prosecutors said.

Rivera, of the 1000 block of Prospect Bouelvard in Elgin, initially was charged with attempted murder, but agreed to a plea deal for concurrent sentences of eight years for the shooting and 10 years for the drug offense, prosecutors said.

He must serve at least 85 percent of the sentence and was given credit for 416 days served at the Kane County jail.
