Instead of scoring his beloved birthday sex, Chicago R&B hitmaker Jeremih had a birthday bust on the day he turned 28.

TMZ reports the singer was pulled over by the California Highway Patrol early Friday and booked on a DUI charge. He spent the opening hours of his birthday in jail until being released on bail around 11 a.m. — in time to make it to San Diego for a nightclub birthday bash.

The Morgan Park High and Columbia College broke out with the single “Birthday Sex” in 2009 and followed up with the hits “Down on Me” and “Don’t Tell ‘Em.”
